TERMS AND CONDITIONS
 

The following booking terms and conditions (the “Terms and Conditions“) form the basis of your contract with Pudu Puda LLP (operating under the name “Pudu Puda Travel”), a limited liability partnership incorporated under the laws of Singapore with registered number T18LL0605J and whose registered office is at 123 Jalan Lim Tai See, Singapore 268452 (the “Company” or “PP“). Please read them carefully as they set out our respective rights and obligations. “You”, “your” and “Client” refer to anyone whose name is on the Exploration booking, including anyone who is added or substituted at a later date. “We”, “us” and “our” mean Pudu Puda LLP.

 

RESPONSIBILITIES OF THE LEAD CLIENT

The primary person named on the booking (and eventually reflected in the invoices) is hereinafter referred to as the “Lead Client”, and is responsible for the following:

  • Acknowledges on behalf of all persons mentioned in the booking, that they have read and accepted these Terms and Conditions,

  • Provides consent for the use of personal information as outlined in our Privacy Policy,

  • Confirms that all persons on the Exploration assumes financial responsibility for all other individuals named in the booking. If a person is under 18 years of age, that person is deemed a minor and bookings can only be made on the minor’s behalf by his/her parent or guardian.

 

The Lead Client must be 18 years old and above. 

 

SCOPE OF SERVICES


Your Exploration is defined as the itinerary which bears the booking code that corresponds with your invoice. The services which are included and excluded as part of the Exploration are detailed under the section “What’s Included”. For the avoidance of doubt, any service shall not be construed as included even if it is not mentioned in the “What’s Excluded” section. The booked Exploration is only valid for the dates indicated in the invoice. 

 

BOOKING YOUR TRIP AND PAYMENT

No Exploration arrangements, including but not limited to accommodation, transportation and activities, are considered confirmed until we receive a deposit from you, which is calculated as 30% of the total price (the “Exploration Price”). For certain arrangements, our suppliers concerned may require full payment prior to the due date of your remaining balance. If this applies to your booking, we may request an additional deposit payment. For all avoidance of doubt, the Exploration Price covers the services included in the itinerary, and not any other costs which you may have incurred in relation to this Exploration not provided by us.

 

Remaining payment of the Exploration Price is due 90 days prior to your departure date, and we will issue a separate invoice for this amount. If you book your Exploration less than 90 days before your departure date, you will need to pay for the full Exploration Price at the time of booking.

 

There should not be any changes to the Exploration Price, except due to changes in local taxes (both in Singapore and in your destination) and adverse exchange rate variations. We will notify you accordingly of the impact of any such changes if the revised Exploration Price increases by more than 3% of the original Exploration Price. You then reserve the right to cancel your Exploration within 10 business days of us notifying you of such an increase, after which the increase will be automatically applied to your remaining payment.

 

We use an online accounting platform, Xero, to issue our invoices. It is your responsibility to check your e-mail inbox in case these electronically issued invoices end up in your spam folder. All prices quoted and payments are dominated in Singapore Dollars (SGD), US Dollars (USD) or otherwise stated in our invoices. Payment details by bank transfer, PayNow (for Singapore bank users) and credit card can be found in our invoice. Please note that we will charge a 3.5% processing fee applied to the invoiced amount for payments made by credit card.

 

CANCELLATION POLICY

If you must cancel for any reason before departure, the refund amount will be calculated after deducting our cancellation fees as stated in the next paragraph, as well as any advance payments made to airlines, hotels and local operators which are non-refundable. We recommend that you speak with us in order to determine the best way forward. 

 

As we incur costs from the time of your booking, our cancellation fees are as follows:

  • 91 or more days before departure – 30% of Exploration Price (i.e. initial deposit),

  • 61-90 days before departure – 50% of Exploration Price, and

  • 60 days or less before departure – no refund

 

A travel party of 10 or more persons will be considered group travel, and may be subject to additional terms and conditions, which we will inform you of at the time of your booking. For groups, our cancellation fees are as follows:

 

  • 121 or more days before departure – 30% of Exploration Price (i.e. initial deposit),

  • 91-120 days before departure – 50% of Exploration Price, and

  • 90 days or less before departure – no refund

 

All cancellations must be communicated to us in writing and shall be deemed accepted from the date our written confirmation is sent. We will not refund to you any deposits, administrative fees or alterations fees. No refunds will be given if a participant decides to leave the Trip early for any reason. Refunds made to the client will be made within 30 days from the date our written confirmation is sent, net of any applicable bank charges to be borne by you.

 

REPLACEMENT OF CLIENT

In the event that you are unable to participate in the Exploration, you may transfer your place to someone else, so long as the transfer is accepted in writing by us. The replacement traveller is deemed to have read and accepted these Terms and Conditions, as well as bear responsibility for all costs incurred by us and any of our suppliers for the change, an administrative amendment fee of USD200 and any remaining payment must be paid before any such transfer is considered effective. 

 

NO SHOW

Failure to travel without prior notification is considered a no show and the entire cost of Exploration is non-refundable.

 

PASSPORT, VISA AND TRAVEL DOCUMENTS

It is your responsibility to ensure that your passport is valid for at least 6 months after the last day of your Exploration, defined as the date you arrive in your country of residence. It is also your responsibility to ensure that you have the valid visa(s), inoculation certifications and other necessary travel documents as may be required to participate in the Exploration and conforms to the regulations required by the corresponding destination’s health authorities, including for any country you may be required to transit in. PP shall neither be responsible in the event you are refused entry into the destinations for your failure to produce the necessary documents, nor for any fines, surcharges or financial penalties you may incur as a result.

 

We are able to provide details on mandatory health requirements as stipulated by the local health authorities of the destination you are travelling to. However, we are not medical experts and the information we provide should not be deemed as medical advice. It is your responsibility to ensure that you obtain proper and detailed medical advice prior to travel.

 

TRANSPORTATION

PP may or may not be procuring your transportation arrangements, unless otherwise stated in your Exploration, including but not limited to air tickets, boat and car transfers. It is your responsibility to check in for your flights with sufficient time as recommended by the respective airline, and to be at the meeting point punctually for all ground travel arrangements. PP is no liable if you fail to do so, and no credits or refunds will be given to you.

 

Air tickets are generally valid only for transport on the specified airlines for which they have been purchased, according to your travel reservation with the airline(s). Changes to the itinerary, change in cabin class and / or additional stopovers may result in penalties and availability. We are only able to assist with changes for transportation arrangements booked by us. If you booked your air tickets on your own, it is your responsibility to make any required change on your own. Flight tickets must be used in the booked order; failure to use certain flight routes may result in the loss of your right to travel on all booked flights on the same reservation, or in the airlines imposing penalties and additional costs. 

 

BAGGAGE & PERSONAL PROPERTY

You are responsible for your baggage and personal property at all times. PP is not responsible or liable for any delay, loss or damage to baggage and personal property.

 

TRAVEL INSURANCE

You acknowledge that it is highly recommended that you obtain personal travel insurance with sufficient coverage for unforeseen circumstances including, but not limited to, flight delays, flight cancellations, medical, personal accident/injury, oss of personal effects, evacuation and repatriation, and all other expenses which might arise in connection with the Exploration, and covers all applicable dates of travel including travelling to and from the destination. It is your responsibility to place insurance up to the relevant limits you may require. It is also your responsibility to ensure that your insurance policy has sufficient coverage for the type of travel and nature / associated risk of activities which are included in your Exploration. 

 

Specifically, as required by the Travel Agents Regulations 2017 of Singapore, we are required to recommend that you purchase travel insurance (i) against any failure or disruption in the provision of the eligible travel product (the “Eligible Travel Product”) arising out of any insolvency on the part of the licensee (i.e. Pudu Puda LLP); and (ii) in your favour under the Eligible Travel Product. The Eligible Travel Product is defined as the Exploration offered by us that is delivered wholly or partly outside Singapore.

 

FORCE MAJEURE

We shall not be liable for delay or failure in the performance of any of its obligations if such delay or failure is due to acts of God, fires, earthquakes, natural disasters, acts of war, terrorism, floods, intervention by any government authorities or such similar events, epidemic or epidemic control and preventative measures that render performance illegal or impossible (each a “Force Majeure Event”). PP shall use its commercially reasonable efforts to mitigate the effect of such delay or non-performance, and shall continue such performance as soon as practicable after the end of the Force Majeure Event.

 

COMPLAINTS

In the unlikely event that you have any reason to complain or experience any problems with your Exploration whilst away, you must immediately inform the guide at the destination, the supplier of the service(s) in question (e.g. hotel) or local emergency contact (which will be provided in our Pre-Departure Information Dossier). Any verbal notification must be put in writing and given to the guide, local agent or supplier as soon as possible. If any complaint or problem is not resolved to your satisfaction by the guide, local agent or supplier, you must contact us in Singapore using the contact details we have provided you with during your trip, giving us full details and a contact number. We are unable to assist to resolve a complaint or problem until it is made known to us. If you remain dissatisfied, however, you must write to us within 14 days of the end of your Exploration, providing your booking reference and full details of your complaint. For all complaints and claims which do not involve death, personal injury or illness, we cannot accept liability if you fail to notify the complaint or claim entirely in accordance with this section. In the unlikely event you have a complaint which we cannot amicably resolve, you may, as an alternative to bringing a claim in the courts or through mediation or arbitration in Singapore.

 

PRIVACY POLICY

You agree and consent to PP collecting, using, disclosing and sharing your personal data provided for the purpose of the Exploration as well as in their records from time to time, and disclosing such personal data to service providers, and relevant third parties for purposes reasonably required by PP to provide you with the services you are requesting. Such personal data may include but are not limited to passport details, health conditions, dietary restrictions and allergies.

 

From time to time, your guide may take photographs and videos of you during the trip in order to provide an update to your travel consultant. It is our company policy not to publish or share any images of our clients on any external platforms. 

 

AGREEMENT TO FOLLOW RULES, LAWS AND POLICIES

During the Exploration, you agree not to consume or transport illegal / controlled substances. You agree to abide by and comply with all instructions and rules of PP and our proxies (guide, local agent or supplier), including any decision to limit or terminate the activity due to weather, physical capabilities or skill level of a participant, medical necessities or for any other reason. Furthermore, you understand that it is your responsibility to follow all rules and instructions without being reminded or told to do so, and that any failure on you part to follow these rules may increase the risk of serious injury or death. Unless written consent is given to you to the contrary, you must strictly observe and comply with all applicable laws, rules, policies and directions of the hotel(s) where you will be staying at as well as of the destination where you will be travelling to.

 

ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS

You acknowledge that overseas travel is not without risks. You understand that these risks may result in serious injury or death and that no amount of care, caution, instruction or expertise can eliminate this inherent danger.

 

You agree and promise to accept and assume full responsibility for all of the known and unknown risks of overseas travel, including the risk of serious injury or death. Your participation in the Exploration is voluntary and you elect to participate in spite of these known and unknown risks.

 

REPRESENTATION OF FITNESS

You are physically fit and do not have any medical condition that would limit or inhibit your ability to engage in the Exploration. If you have any medical conditions that may affect your abilities, including but not limited to pregnancy, heart conditions, asthma, diabetes or hypoglycemia, you have disclosed your condition with PP and have taken all necessary steps to ensure that your condition will not affect your safety or the safety of others during the Exploration. You are capable of participating in the activities as part of the Exploration's itinerary. You agree to cease your participation immediately if you feel you are not capable of continuing.

 

AUTHORISATION OF AND CONSENT TO MEDICAL TREATMENT

You authorise any medical treatment deemed necessary in the event of any injuries while participating in the Exploration. PP and / or its staff can, at your cost, arrange any emergency evacuation service as it or they deem necessary for your health and safety. In the event that you require medical care, you either have appropriate insurance, or, in its absence, agree to be financially responsible for and pay for all costs of rescue, emergency and medical services that may be incurred as a result of such treatment. You agree to provide financial reimbursement for any related costs incurred by us.

 

WAIVER AND RELEASE OF LIABILITY

In consideration of the risk of participating in the Exploration, and as consideration for the right to participate in the Exploration, you hereby release, waive, discharge and indemnify PP and their directors, employees and service providers (collectively the “Releasees”) from and covenant not to sue the Releasees or any of them for, any or all liability, claims, demands, costs, expenses, actions, or causes of action of any kind, arising out of or in relation to any and all loss, personal injury, death, damage to or loss of property, or any consequences thereof, that you may suffer as a direct result of your participation in the aforementioned Exploration, including traveling to and from the Exploration, except to the extent due to the gross negligence of the Releasees in the case of personal injury or death.

 

INDEMNIFICATION FOR THIRD PARTY CLAIMS

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless the Releasees from and against any and all losses, claims, damages, liabilities, obligations, penalties, judgments, awards, costs, expenses, and disbursements (and any and all actions, suits, proceedings and investigations in respect thereof and any and all legal and other costs, expenses and disbursements in giving testimony or furnishing documents in response to a subpoena or otherwise) arising out of or in connection with: (a) your breach of this Agreement and/or any of the warranties you have given herein; (b) your failure or alleged failure to comply with any applicable laws, regulations and rules during the Trip; and (c) all your activities, acts and/or omissions occurring within the duration of the Trip but which are not undertaken in direct connection with any goods and/or services provided by the Releasees.

 

GOVERNING LAW AND SEVERABILITY

You agree that these Terms and Conditions are intended to be as broad and inclusive as is permitted by the law of Singapore and that if any portion thereof is held to be invalid or unenforceable, that the remainder of the Terms and Conditions shall, notwithstanding continue in full legal force and effect. 

 

These Terms and Conditions are governed by the laws of Singapore. Any dispute arising out of or in connection with these, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (the “SIAC”) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (the "SIAC Rules") for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The Tribunal shall consist of one arbitrator. The language of the arbitration shall be English.

 

AMENDMENTS

The Terms and Conditions which apply to your Exploration are as featured on this website, as well as any other terms notified to you in writing before the commencement of your Exploration. We reserve the right to update these Terms and Conditions from time to time, and any such update shall take effect immediately upon posting on our website. Any provision of these Terms and Conditions may be amended, waived or modified by written consent of PP.
